Arizona 40+, 45+, 50+ and 55+ Retirement Communities


Arizona retirement homes for sale in Chandler, Gilbert, Mesa, Goodyear and SurpriseHUD has provided an exception to Fair Housing Law, allowing a community to discriminate based upon the age of prospective occupants in age-qualified Arizona retirement communities, providing at least 80% of the dwellings have at least one age-qualified, 55+ occupant living in the property. This requirement remains the same for owner-occupied or tenant-occupied rental homes. There are other requirements, but for the purposes of this post, they are not pertinent. Per HUD most age-qualified retirement communities in Arizona have the option to allow up to 20% of the dwellings to be occupied by an occupant being at least 40 or older, as specified in the age-qualified community bylaws. This is why some are saying they are 40+, 45+, 50+ or 55+ communities.

But to be in compliance with the law, HUD requires age-qualified communities to maintain records to document the age of occupants of every residence within the community and be able to prove they are in compliance with the law. If they are not found to be in compliance, the community will forfeit their ability to restrict occupancy based upon age.

Most Arizona "Active Adult", age-restricted retirement communities require all dwellings be occupied by at least one occupant is 55 or older to simplify their record keeping to ensure all new owners comply with the age requirement and not jeopardize losing the privilege of being able to discriminate based upon age. Every retirement community has the latitude to set their minimum age of one of the occupants for up to 20% of the homes in the community.

The lists below is a partial list of Arizona age-restricted retirement communities that can change at any time.

40+ Age Restricted AZ retirement communities, subject to review by the HOA:

  • Sun Lakes - an unincorporated area of Maricopa County between Chandler and the Gila River Indian Reservation.
  • Pebble Creek - in Goodyear north of I10 and east of the 303.
  • Robson Ranch - in Pinal County in Eloy southeast of the I10 and I8 intersection.
  • Westbrook Village - in Peoria northwest of Bell Rd and the 101 Loop.

45+ Age Restricted AZ retirement communities, subject to review by the HOA:

  • Leisure World - in Mesa north of US 60 and west of Power Road.
  • Sun City Festival - North of Sun Valley Parkway and west of US 60.
  • Sun City Grand - in Surprise located north of Bell and west of US 60.

The remaining Arizona retirement communities in the greater Phoenix AZ area require every residence to have at least one adult 55 years of age or older.
